A group of Black immigrant advocates has filed a civil rights complaint to the Department of Homeland Security alleging Immigration and Customs Enforcement (ICE) agents placed African asylum seekers in a medical constraint to torture them.

According to the complaint, ICE agents used a full-body restraint called the WRAP on five Cameroonian immigrants during mass deportations back to the African country in 2020.

The group of advocates claims it led to a medical complication for one of the deportees after the men remained bound for several hours.

The complaint was filed by African Communities Together, the Black Alliance for Just Immigration, the Cameroon Advocacy Network, Haitian Bridge Alliance, the UndocuBlack Network, Texas A&M University School of Law Immigrant Rights Clinic and Witness at the Border.

Enduring a several month long voyage in a wooden sailing ship during the early 1600's was probably more of an inconvenience, more of a peril, than wearing a WRAP restraint device for a few hours during a 6 hour transatlantic flight.

Flawed inspections have allowed a gross failure in ICE’s oversight of the immigration detention system. ICE should terminate its contract with Nakamoto. But ending this contract alone is insufficient to ensure robust and effective oversight of the detention system. There are three additional steps that are critical to meaningful reform of ICE’s detention oversight system: (1) ICE must ensure frequent and rigorous inspections conducted by independent actors, on the basis of objective criteria, with clear procedures for evaluating detention conditions; (2) ICE must establish and enforce specific consequences for failed inspections, including probation and termination of facility contracts within 60 days upon repeat findings of non-compliance; and (3) ICE must provide transparency into ICE’s inspection system, making all findings of non-compliance and information regarding all enforcement actions against non-compliant detention facilities publicly available.

Biden administration exits talks over compensation for families separated at border - NBC News
NBC News previously reported that the administration had been in talks to offer separated migrant parents and children hundreds of thousands.

The Biden administration has pulled out of negotiations with lawyers representing families separated at the border that would have provided them with financial compensation, the American Civil Liberties Union said Thursday.

“There’s no explanation for not settling these cases other than the Biden administration is unwilling to use literally any political capital to help the young children deliberately abused by our government,” said Lee Gelernt, deputy director for the ACLU’s Immigrants’ Rights Project.

Gelernt said that the Biden administration “will now be in court not just defending the United States but also the individual federal officials responsible for family separation.” These families had been separated at the border by the Trump administration.

The White House directed requests for comment to the Department of Justice, citing active litigation. The DOJ did not immediately return a request for comment.

Under former President Donald Trump’s “zero tolerance” policy in 2018, and a similar pilot program in 2017, more than 5,600 children were separated from their parents simply because their parents crossed the border illegally with them. The Biden administration ended the "zero tolerance" program earlier this year.

They know if they do this proper and humanitarian thing that the right wing and all right wing media will viciously attack 24 hours a day seven days a week until the next election and they don’t want to take that risk, is the only thing I can think of.

But yes they are wrong they should do it anyway because the right wing is going to attack anything decent anyone decent no matter what they do or don’t do.

Yeah, anticipating what anti-immigrant racists might or could do is not a good rationalization for this policy. It's the same game the Obama administration played, trying to placate those people with harsh deportation measures.

Pro tip: supremacists of any kind can never be placated, particularly not ladder-pulling, anti-immigrant supremacists.

Trying to appease racist bigots is a losing game, starting with for the migrant families and their little kids.

Still, 38.4% of Cameroonian asylum claims were denied in FY 2020.

White House officials ultimately decided that a settlement had become a greater political liability than any potential fallout from a broken promise.

ate last week, after ten months of negotiations, the Biden Administration withdrew from settlement talks aimed at providing financial compensation to families who’d been separated at the border by the government of Donald Trump. The move was a shock even to current and former Administration officials. Previously, the President had left little room to doubt what he thought of the Trump Administration’s decision to deliberately take some four thousand children from their parents in order to intimidate future asylum seekers. It was “criminal,” “abhorrent,” and “violates every notion of who we are as a nation,” Biden has said. Last month, he said of the parents, “You deserve some kind of compensation, no matter what.”

What changed the President’s mind? One answer is his growing skittishness about appearing too lax at the border. Another is Fox News. In October, the Wall Street Journal reported that advocates were asking the government to consider giving four hundred and fifty thousand dollars to each family member that had been separated under Trump’s zero-tolerance policy. This number, according to sources with knowledge of the talks, wasn’t final; the D.O.J. hadn’t agreed to it, and the government’s opening bid in the negotiations, which remains undisclosed, was substantially lower. But Republicans wasted no time using the figure to attack Biden. “While American families are struggling,” Senate Minority Leader Mitch McConnell said, “the President now wants to make millionaires out of people who crossed the border illegally.” Together with three other Republican senators, McConnell went on to introduce a bill to block any payments; they called it the “Protect American Taxpayer Dollars from Illegal Immigration Act.”

The Biden administration needs a new policy toward migrants fleeing violence and poverty and to get behind grassroots democratic reform.

For the last three months, the US government has repatriated more than 10,000 Haitians, according to data from the United Nations’ International Organization for Migration. Advocates tracking US Immigration and Customs Enforcement flight data put the figure closer to 12,000. These quick border expulsions — 44 percent of whom are women and children, including infants — are happening because current US policy is to turn back almost every asylum seeker who shows up at our borders.

But the country — the poorest in the Western hemisphere — is in no condition to safely welcome back these returnees, making the expelling of these families under a persistent Trump-era rule morally unconscionable.

Senate Parliamentarian Worked in Two Immigrant Detention Centers, Records Show - Latino Rebels
MacDonough’s employment records obtained by Latino Rebels from the U.S. Office of Personnel Management show that after graduating from Vermont Law School, MacDonough worked at not one but two immigrant detention centers for Immigration and Naturalization Services (INS), the agency that once managed the federal deportation workload now tasked to U.S. Immigration and Customs Enforcement (ICE).

According to the records, MacDonough worked for INS from March 1998 until June 1999, when she left to join the Office of the Senate Parliamentarian, where she has worked ever since. The late former Sen. Harry Reid (D-NV), who was the majority leader at the time, promoted MacDonough to Chief Parliamentarian in 2012.

While working for INS, MacDonough was paid $26,075 per quarter for “legal and clerical assistance” at the Chittenden County immigrant detention facility in Vermont, before being promoted to law clerk at the Elizabeth, New Jersey detention facility in late 1998, which nearly doubled her adjusted base salary to $46,182 per quarter.

“Prosecutors are the most important person in the courtroom,” said Sophia Gurulé, an immigration attorney who has worked in the detention facilities where MacDonough once prosecuted immigrants.

“They have the most power to dictate what happens to a person placed in removal proceedings,” said Gurulé.
